Simbye Ltd, a company incorporated under the laws of the United Kingdom, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("Simbye", "we", "us", or "our"), provides prepaid eSIM services, virtual phone numbers, and related digital products through its website simbye.com and the "Simbye" mobile application on iOS and Android (collectively, the "Service").

By accessing or using the Service, you indicate that you have read, understood, and accepted these Terms and Conditions ("Agreement"). If you are not eligible to use the Service or do not agree to the Agreement, you are not permitted to use our Service.

This Agreement does not create any agency, partnership, joint venture, or employment relationship. Neither party is authorized to represent or bind the other in any manner.

1. Service Description

1.1 Prepaid eSIM Plans

Simbye is a prepaid eSIM profile reseller offering data plans for over 190 countries. Each eSIM is delivered electronically as a QR code or activation link via email and through the Simbye App.

1.2 Build Your Own eSIM (App-Only Feature)

Through the Simbye App, customers may design custom eSIM plans by selecting up to 10 countries, choosing a data volume between 5 and 50 GB, and a validity period between 30 and 365 days. Build Your Own eSIMs are available exclusively in the mobile App and are not sold via the Website.

1.3 Top-Up Service

Existing eSIM users may purchase additional data ("top-ups") to extend their data allowance or validity period, subject to network and provider availability.

1.4 US Virtual Phone Numbers

Simbye offers prepaid US virtual phone numbers for SMS reception (and limited voice, where supported) at a price of 14.99 EUR / 14.99 USD per 30 days. Virtual numbers may be used for receiving SMS verification codes from supported services. Auto-renewal is optional and can be toggled in the App. Numbers expire automatically if not renewed and may be reassigned to other users.

1.5 Simbye Wallet

Customers may store credit in the Simbye Wallet (denominated in USD) and use it to pay for any Simbye product. Wallet credit is non-transferable, non-refundable in cash, and has no expiration date as long as the account remains active. Wallet balances may be funded by purchases, referral rewards, or cashback.

1.6 5% Cashback

Eligible purchases (eSIMs, top-ups, virtual numbers, Build Your Own plans) automatically earn 5% cashback credited to the Simbye Wallet of the registered customer. Cashback is not granted on Wallet top-ups, refunded orders, or fraudulent transactions.

1.7 Referral Program

Each registered customer receives a unique referral code. When a new customer makes their first qualifying purchase using your code, both the referrer and the referred customer receive a Wallet credit (currently 3.00 USD each, subject to change). Limits apply: maximum 10 successful referrals per day and 30 per week. Self-referrals, fraudulent referrals, and abuse will result in revocation of all referral rewards and possible account suspension.

2. Eligibility

You must be at least 16 years of age and capable of entering into a legally binding contract to use the Service. By using Simbye, you confirm that all information you provide is accurate, current, and complete.

3. Account Registration

You may use Simbye as a guest, but certain features (Wallet, Referral, Build Your Own eSIM, order history) require a registered account. You may create an account using your email address or sign in with Apple or Google. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Pricing, Payment & Currency

  • All prices are displayed in your local currency where supported (USD, EUR, GBP, CHF, PLN, TRY) and are inclusive of applicable taxes.
  • Payment is processed exclusively by our PCI-DSS-compliant payment processors.
  • Orders are deemed final once payment is successfully captured.
  • Simbye reserves the right to change prices at any time. Changes do not affect orders already placed.

5. Delivery

eSIM profiles and virtual phone numbers are delivered electronically. Delivery typically occurs within minutes of purchase by email and through the Simbye App. Delivery times may occasionally be delayed due to network provider availability or fraud-prevention checks. No physical product is shipped.

6. Activation & Compatibility

It is your responsibility to verify that your device is eSIM-compatible and unlocked before purchase. A list of compatible devices is provided on our Website. Simbye is not responsible for activation issues caused by incompatible, locked, or carrier-restricted devices.

7. Refunds & Cancellations

Please refer to our Refund Policy for full details. In summary:

  • Unactivated eSIMs may be refunded within 30 days of purchase.
  • Activated eSIMs are non-refundable except in cases of verified network failure caused by the provider.
  • Virtual phone numbers are non-refundable once provisioned.
  • Wallet top-ups are non-refundable but can be used for any future purchase.

8. Acceptable Use

You agree not to:

  • Use the Service for illegal, fraudulent, abusive, or harmful purposes.
  • Attempt to bypass fraud-prevention systems, abuse promotional codes, or create multiple accounts.
  • Reverse-engineer, modify, or distribute our App or Website code.
  • Use virtual numbers to harass, threaten, spam, or impersonate others.
  • Resell Simbye eSIMs or virtual numbers without prior written authorization.

9. Network & Service Limitations

Simbye relies on third-party telecommunications networks. Network coverage, speed, and availability depend on the underlying carrier and may vary by location. We do not guarantee uninterrupted service. Simbye is not liable for service degradation or outages caused by network operators or external factors (e.g. local regulatory blocks, force majeure).

10. Intellectual Property

All content, trademarks, logos, code, and design on simbye.com and the Simbye App are the property of Simbye Ltd or its licensors. You may not copy, reproduce, or use them without prior written consent.

11. Privacy

Use of the Service is also governed by our Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law, Simbye Ltd, its directors, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific Service giving rise to the claim.

13. Changes to the Service & Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time. Material changes will be communicated by email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraud, or misuse the Service. You may delete your account at any time via the App settings or by contacting support.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of London, United Kingdom, except where mandatory consumer protection law in your country of residence provides otherwise.
