By accessing or using the service, you indicate that you have read, understood, and accepted this agreement. If you are not eligible to use the service or do not agree to the terms of this agreement, you are not permitted to use our service. According to these Terms and Conditions, no agency, partnership, joint venture, or employment relationship is created. Neither party is authorized to represent or bind the other party in any manner. 1. Service Description Simbye is a prepaid ESIM profile reseller that enables travelers to use data abroad at the most competitive prices without the need to insert a physical SIM card. 2. Registration By signing up and using the eSim application, you agree to the Terms and Conditions of this service as well as the operational rules, policies, and procedures. These are published by us from time to time on the application and may be incorporated by reference and updated periodically. 3. Privacy Policy Our commitment is to the secure storage and protection of your personal data. Various industry-standard security technologies and procedures are applied to ensure your personal information is protected against unauthorized access, use, or disclosure. By accessing or using Simbye, you agree that we can use the information provided at the time of service registration to contact you and obtain your feedback. This information may later be used to inform you about future services we might offer. You have the option at any time to ask us to adjust or delete the information you have previously shared with us. In addition, we automatically collect information about your use of Simbye, including your devices, operating systems, and IP address. This data is analyzed to troubleshoot emerging issues, learn more about the use of our products, and make improvements. Note that this Privacy Policy may be revised occasionally, and we will notify you of changes to the way we use your personal information. It is your responsibility to keep your personal data up to date at all times. 4. Registered Intellectual Property Rights You may not use our trademarks, logos, IP rights, trade names, other brand distinguishing features, or material that is copyrighted or associated with Simbye without our prior consent. You may not remove any information or indications of authorship, ownership of rights, or trademarks of Simbye. Simbye Ltd is the owner or licensee of all intellectual and industrial property rights related to the service. Using the service does not transfer any of these rights to you or other service participants. 5. Simbye Account i. Activation of the Simbye Service To activate the Simbye service, install the mobile Simbye application on your Android or iOS smartphone or visit our website www.simbye.com. Activating Simbye is your responsibility. After purchasing the eSIM, it is immediately visible under the "My Profile" tab on the website and/or app. The contract is automatically terminated if the customer does not have an active data package 180 days after purchasing the eSIM or the eSIM was deleted from the device. ii. Fees Payment is made via debit/credit card and is processed and secured through Shopify Payments for our shop. Simbye uses Shopify Payments to ensure the security of your payment transactions. All customer data is encrypted and tokenized by Shopify Payments, providing a highly secure method for processing card payments. Shopify Payments, our chosen payment processing partner, adheres to the highest standards of security and compliance in the payment industry. Simbye Ltd does not store or process any sensitive credit card data on its servers. All card transactions through Shopify Payments are secure and trustworthy. By purchasing Simbye services, you agree to the terms of this arrangement and the terms of your card provider. Customers register and purchase their SIM cards on the website https://www.simbye.com and/or the Simbye app. Payments are made via PayPal (https://paypal.com) and Shopify Payments, using an alias of your credit card (virtual credit card print). iii. Termination of Service You may terminate the service at any time by deleting the application or deactivating your Simbye account in the application. Termination takes effect immediately. Termination by you does not affect payments you have made before your termination, and there is no entitlement to refunds for unused portions of the service. We reserve the right to terminate the service at any time for important reasons. 6.1. REFUNDS AND CANCELLATIONS 6.1.2. A request for a refund can be made within thirty (30) days of the purchase date, provided activation is no longer possible after extensive joint troubleshooting. 6.1.3. Cooperation with the customer for immediate problem resolution is required for a refund to be granted. 6.1.4. Each data package has a specific validity period. After this validity period expires, no refunds of any kind are given for remaining data. 6.1.5. No refund or compensation is granted for charges from alternative phones, alternative SIM cards, alternative providers, hotel phones, or other charges not directly associated with the customer's Simbye eSIM account. 6.1.6. Fraudulent Purchases: Simbye reserves the right to refuse refunds if there are signs of abuse, violation of our Terms and Conditions, or fraudulent activities associated with the use of Simbye products and services. 6.2. Use of Simbye Services By using the services, you agree to comply with the provisions of these Terms and Conditions as well as applicable laws. This includes, in particular, privacy, image rights, honor and reputation, the protection of personal data, labor relations, non-discrimination, and confidentiality. The services must not be used in a way that impairs their quality or disrupts services for third parties. It is your responsibility to ensure that your device is compatible with eSim and not blocked by a mobile service provider, as this is a prerequisite for purchase. Device compatibility depends on both the mobile service provider and the country of origin. Please check compatibility. Note that the list of compatible devices may not be exhaustive, as newly announced devices may not have been added yet. You have the right to request a refund or a change of package if the eSim cannot be activated due to a proven valid technical problem by Simbye. No refund is given for an incompatible device, as this is clearly stated before purchase in the app. If a user does not use their eSIM account within 180 days from the last purchase date, the eSIM will be manually deactivated by Simbye. After deactivation, the eSIM can only be reactivated through specific steps. Upon deactivation of the eSIM, the user may lose any remaining data balance or associated credit. Simbye is not responsible for data losses or credits resulting from the deactivation of the eSIM. You are obligated to inform us immediately if the device on which the services are activated is lost or stolen. In the meantime, you are solely responsible for the use of the services on the device. You are solely responsible for all content, information, and communications transmitted through the service. You agree that Simbye assumes no responsibility for the misuse of the service. Simbye reserves the right to block the service at any time if there is a suspicion of violation of these Terms and Conditions. You agree to observe and comply with all applicable laws and regulations. You acknowledge that your use of the service can be influenced by factors outside our control, including the location and performance of your device, your wireless networks, and the Internet. 7. Compensation By using the service, you agree to indemnify and hold harmless Simbye Ltd and its affiliates, officers, directors, employees, and agents from all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the service or your breach of these Terms and Conditions. 8. Limitation of Liability Simbye Ltd is not liable for any indirect losses or consequential damages, including lost profits, revenue, data, or use, arising from the use of the service. The total liability of Simbye Ltd for any claims arising from or in connection with the service is limited to the actual amount paid for the service during the twelve-month period prior to the event triggering liability. 9. Changes Simbye Ltd reserves the right to change or update these Terms and Conditions at any time without prior notice. Changes take effect as soon as they are published on the website or in the application. By continuing to use the service after such changes, you agree to the updated Terms and Conditions. 10. Governing Law The provisions of these Terms and Conditions are governed by the laws of England and interpreted in accordance with them. Any legal proceedings or actions arising from or in connection with these conditions are exclusively under the jurisdiction of the courts of London. 11. Third-Party Involvement Simbye Ltd is not responsible for third-party resources on the Internet, including third-party websites that refer to or are referenced by the service. You acknowledge that we have no control over such websites and resources and are not responsible for their availability. 12. Disclaimer The failure to enforce individual provisions of these Terms and Conditions does not constitute a waiver of Simbye Ltd's right to enforce these provisions at a later time. 13. Force Majeure Simbye Ltd is not liable for delays or failures due to circumstances outside its reasonable control, including natural disasters, government actions, wars, terrorism, civil unrest, labor disputes, or failures of third parties. 14. Disclaimer of Warranties Although the service is provided professionally and in accordance with applicable regulations, we make no express or implied warranties or representations regarding the service. 15.
